I hereby release and forever discharges Xebraco, Inc. d/b/a Koru Healing Arts, Kristin Haber and all its affiliates, employees, agents, successor, and assigns from all liabilities that may occur from injury, mental distress or loss during this guided breathwork class.  By signing below and taking this class I hereby acknowledge that I understand any potential risks of taking this breathwork class, workshop and/or course. I have read or received all knowledge, rules, warnings and restrictions of the activity of guided breathwork. 

I certify that I understand the risks associated with the breathwork and agree that I will not hold the Koru Healing Arts or Kristin Haber  responsible for any injuries or losses I sustain during the activity. I agree to release Koru Healing Arts and Kristin Haber from any claims, actions, demands, causes of action, or legal suits of any kind.  

I will be held solely responsible for any damages to myself, others, or property, if my willful misconduct, negligence, or disregard for the rules of the activity leads to it.

Assumption of Risk & Release:                                                        

I understand the risks associated with the activity of breathwork, including, but not limited to, the following: It may cause without limitation the loss of consciousness, dizziness, lightheadedness, tetany, and tingling sensations which all can pose a danger to my health and well-being especially when unsupervised.  I understand that I will be participating with other participants enrolled in the class and I will release Koru Healing Arts and Kristin Haber from liability for any incident that would arise with an incident caused by another individual participant of class.  

I acknowledge that I will ensure my own proper supervision, monitoring and/or safeguards, when practicing at home or in-person in studio and release and forever discharge Kristin Haber,  Koru Healing Arts (Fort Collins Co 80525), and all of its employees, associates, directors,  from all actions, causes of action, damages, claims, and demands whatsoever arising out of the participation in the breathwork course.

Medical Warnings: 

Breathwork is a powerful physiological and physical modality of breathing. The rigorous breathing can exacerbate or trigger any of the listed pre existing health related or physiological conditions stated here. If you have any of the below in your medical history it is not advised that you participate.

Breathwork is not advised for persons with a history of cardiovascular disease, including angina or heart attack, high blood pressure, glaucoma, retinal detachment, osteoporosis, significant recent physical injuries or surgery without first speaking with a medical professional. Nor is it advised for persons with severe mental illness or seizure disorders or for persons using major medications. It is also unsuitable for anyone with a personal or family history of aneurysms. Pregnant women are advised against practicing breathwork without first consulting and getting approval from their primary care physician. Persons with asthma should have their inhaler present at all times and consult with their primary care physician.

Indemnification:

I agree to indemnify, hold harmless, and defend the Koru Healing Arts & Kristin Haber against all causes of action, judgment, claims, damages, property damages, costs, or expenses, including attorney fees and other litigation arising from my participation in Breathwork. I understand this Indemnification includes claims for damages, death, or injuries that occur related to my use of or presence upon the facilities that this breathwork course is being held, and while participating in the activity.

No Duress:

I acknowledge that I voluntarily consented to the activity and am under no pressure or duress to sign this Colorado Liability waiver form. I agree that I have received adequate and reasonable time to review this standard release of liability form. I acknowledge that Koru Healing Arts- Kristin Haber may refund any prepaid class fee, and I will not be allowed to participate in the activity if I choose not to sign this form. Participation in this activity is voluntary and I acknowledge that I can withdraw anytime.

By signing below and taking this class, I acknowledge that I have read and agreed to the terms above, and if necessary consulted with my doctor and/or healthcare provider prior to participation in the activity and in particular have discussed without limitation the above risk conditions before taking the course.  Kristin Haber is not a licensed mental health practitioner and makes no representations as such. Any guidance that might be offered during integration is based solely on her personal experience and compassion as a fellow human being with life experience. She can not diagnose, counsel or treat any mental health issue that might arise during breathwork integration. It is highly suggested that participants seek out professional licensed guidance for any issues that might come to the surface during guided breathwork sessions.

I understand that there may be pictures or video taken during the session for purposes of use which may include social media or any type of advertising or promotion and I allow the full use of such media. If I do not consent to the use of media, or have questions I will clearly make the facilitators aware prior to the session.

Acceptance:

The law of the State of Colorado governs this liability waiver, release and indemnification and in the event of any legal disputes, venue and jurisdiction will be in the courts in Larimer County, Colorado.
